Article 1: General
1.1 These are the General Terms and Conditions of Sale and Delivery of Snel parts, located in Amsterdam. Snel parts is registered with the Chamber of Commerce under number 72200987.
1.2 These general terms and conditions of sale and delivery apply to all assignments, offers, and agreements of Shop4trac.com.

Article 2: Ordering and the formation of an agreement
2.1 Orders can be placed via https://shop4trac.com. As soon as the order is completed, a confirmation will be sent by email.
2.2 By placing an order, the buyer indicates their agreement with these terms and conditions.
2.3 Shop4trac reserves the right to refuse an order in the event of deliberate provision of incorrect data and information, or if there has been a history of non-payment or other matters where Shop4trac deems the financial risk too great to deliver. Acceptance of an order may therefore be subject to additional conditions, such as advance payment.
2.4 In case of deliberate provision of incorrect data or any other form of attempted fraud, Shop4trac will report this to the judicial authorities.
2.5 The agreement is only formed at the moment Shop4trac has accepted the order.
2.6 Before completing the order, the buyer must check the contents of the order and their details for accuracy. Due to the speed of orders and shipping, Shop4trac may not be able to implement any further changes. Any costs resulting from incorrect data will be charged to the buyer.

Article 3: Prices
3.1 Prices are in euros, including 21% VAT, administrative costs, and shipping costs. Shipping and administrative costs are calculated per order and depend on the total order amount.
3.2 Shop4trac may adjust its prices at any time. Price changes do not affect contracts already entered into.

Article 4: Delivery
4.1 Delivery for orders placed on working days will normally take place within 2 working weeks (if in stock is indicated on the relevant page). The delivery time is indicative and not a deadline. Items that are shown as “Out of Stock” on the website have a general delivery time of 2 to 6 working weeks.
4.2 Shop4trac is obliged to observe this delivery time as much as possible. However, it cannot be held liable for exceeding the delivery time that was reasonably unforeseeable at the time of entering into the agreement. In such cases, Shop4trac has the right to extend the delivery time or cancel the agreement in consultation with the buyer.
4.3 Shop4trac has no influence on delays caused by the carrier and cannot be held responsible for them.
4.4 If delivery does not take place within a period of 30 days, unless otherwise agreed, the buyer is then entitled to cancel the order and reclaim what they may have already paid. Amounts already paid will be credited within 30 days in this case.
4.5 If a shipment is refused, Shop4trac is entitled to recover the transport costs incurred from the buyer.

Article 5: Transport and risk
5.1 The method of transport, shipping, and packaging is determined by us as a prudent merchant, unless further instructions have been provided by the buyer to Shop4trac. Any specific wishes of the buyer regarding transport/shipments will only be carried out if the buyer has declared they will bear the additional costs thereof.
5.2 Upon delivery of the package, the buyer must sign with one of the delivery personnel to acknowledge receipt of the package.
5.3 The buyer must check the contents of the package after delivery. If the order should unexpectedly be incomplete or incorrect, the buyer must contact us as soon as possible and no later than seven (7) working days after receipt via email at [email protected] or via the contact form on the website.
5.4 All shipments are sent by Shop4trac with increased liability. The risk of damage and loss of a shipment to the buyer is therefore borne by Shop4trac. After the items are received by the buyer, the risk of damage and loss passes to the buyer.

Article 6: Payment
6.1 Payment options are: credit card (Visa – Mastercard); iDeal | Wero; bank transfer (SEPA); PayPal; and Klarna.
6.2 Advance payment can be made via bank or giro. For payments via bank or giro, the date of payment is the date the amount is credited to Shop4trac’s giro or bank account. The delivery time stated in Article 4 is valid from the moment Shop4trac has received the relevant amount in the business account.
6.3 Shop4trac reserves the right at all times to deviate from the payment method chosen by the buyer and to set additional conditions.
6.4 If the buyer is in default with any payment, Shop4trac is entitled to suspend or dissolve any further agreements.
6.5 If the buyer has received the order at home and requests a chargeback from their respective bank, the order in question must have already arrived back at Shop4trac. If this is not the case, Shop4trac will be able to collect the outstanding amount until the order is received subject to the ‘return conditions’.

Article 7: Retention of title
7.1 Delivered items remain the property of Shop4trac until all payment obligations have been met. However, the risk in respect of items already delivered shall already pass to the buyer at the time of delivery.

Article 8: Warranty
8.1 The products sold by Shop4trac via the website are all covered by the manufacturer’s warranty of the respective brands.
8.2 The buyer cannot invoke the warranty in the following cases: normal wear and tear; improper use and/or failure to follow the instructions for use; modifications have been made to the item; damage as a result of intent or gross negligence; the buyer and/or third parties engaged by the buyer have carried out repairs to the delivered goods on their own initiative during the warranty period.
8.3 The buyer is obliged to inform Shop4trac of their claim before returning the item in question. The costs for shipping under warranty are borne by Shop4trac, provided the correct freepost number is used. The following must be taken into account: A warranty number must be requested within the specified warranty period; The product must be shipped within five (5) working days after the warranty number has been granted; The item covered by the warranty must be properly packaged and shipped upon return to prevent damage. The item covered by the warranty must be properly packaged and shipped upon return to prevent damage; The return shipment must include a description of the problem, the warranty number, the buyer’s details, and a copy of the invoice; Problems with shipping by the transport company handling the shipment to Shop4trac are at the buyer’s risk.
8.4 The warranty expires if the buyer has not met the payment obligation.
8.5 Shop4Trac’s liability for damage is limited to the amount of the purchase price of the product in question. Shop4Trac is not liable for indirect or consequential damage, such as lost profits or missed savings. Nothing in these terms and conditions affects the consumer’s legal rights regarding the legal guarantee of conformity or Shop4Trac’s liability for intent, gross negligence, or personal injury.

Article 9: Returns
9.1 The buyer has the right to dissolve the agreement without giving reasons for fourteen (14) working days after receipt. The buyer must request a return number before returning the item.
9.2 After a return number has been granted, the buyer must return the order within five (5) working days.
9.3 Items must be unused, complete, undamaged, and in the original packaging, unless otherwise indicated by Shop4Trac. Excluded from return are items ordered by the buyer with personal engravings, custom colors, and other non-standard modifications.
9.4 A return shipment must always be sent by registered mail, sufficiently stamped, and well-packaged. Shipping costs are borne by the buyer.
9.5 Payments received will be refunded within 14 days after the return notification, minus costs incurred, such as administrative costs, processing costs, and cleaning costs if Shop4Trac decides to accept a used item. Shop4Trac reserves the right to withhold a refund until it has been demonstrated that the item or items have arrived at the specified return address. If only part of an order is returned, the shipping costs of the original shipment are always borne by the buyer.

Article 10: Product Information
10.1 Shop4trac takes great care in providing information about the products offered. However, Shop4trac is not liable for incorrect specifications and/or other indications of the items provided by it.
10.2 Images shown are approximate only and may differ from the actual product. Deviating images cannot be grounds for compensation and/or dissolution of the sale.

Article 11: Privacy
11.1 Shop4trac attaches great importance to the privacy of its customers. All personal information is therefore handled with care. This strictly follows all legal regulations applicable to personal data. Shop4trac uses the personal data provided by the buyer to process orders and, provided the buyer has given permission for this, for marketing purposes.
11.2 Personal data will not be provided to third parties by Shop4trac without the buyer’s permission, unless this is necessary for processing the payment.
11.3 Personal data can be changed at the request of the buyer.

Article 12: Disputes
12.1 Complaints must be submitted clearly by email to [email protected] within a reasonable period. Shop4Trac will respond within 14 days.
12.2 Dutch law applies to these terms and conditions.
12.3 All disputes between the parties will be submitted exclusively to the competent court in the Netherlands.
